Kidnapping
Kidnapping is generally classified as a crime involving
danger to a person. State laws define kidnapping or
abducting as unlawfully removing a person against his or her
will by force, threat or deception, a substantial distance under
the circumstances from the place where he or she is found, or
unlawfully confining another person for a substantial period in
a place of isolation, with any of the following intentions:
 |
Hold for ransom or reward, or as a shield or hostage. |
 |
Facilitate commission of any felony or flight
thereafter. |
 |
Inflict bodily injury on or to terrorize the victim or
another. |
 |
Interfere with the performance by public officials of
any governmental or political function. |
Also, depending on the state, confinement of a child or
minor against his or her will without the consent of his or her
parent or legal guardian, or interfering with the custody of a
child or minor may be considered kidnapping.
In addition to severe state kidnapping penalties, federal
statutes will apply when a victim is transported from one state
to another.
